FUNCTIONS OF THE CONSTITUTION
FUNCTIONS OF THE CONSTITUTION
Whether it is written or not, whether it is practiced or not, the Constitution is a political structure.
They serve several functions:-
1. Ideological Expression:
It represents a nation state's ideology and philosophy.
2. Expression of Fundamental Law:
Constitutions present basic laws that can be changed or repealed by an extraordinary procedure of amendment. There is also special legislation, which typically focuses on citizens' rights, such as language, expression, religion, assembly, the press, property (Rights outside FR), and so on.
It provides governments with an organizational framework. It determines the roles of the legislative, executive, and judiciary, as well as their inter-relationships and limitations on their jurisdiction.
4. Government Levels:
The Constitution usually explains the levels of various organs of government. The Constitution would specify whether it is Federal, Confederal, or Unitary. They demarcate the power of national and regional governments.
5. Amendment provision:
Since it would be impossible to predict all potential possibilities with any degree of certainty, there must be adequate provisions for constitutional amendment. It should provide a collection of instructions for making changes on its own. If the system's scope for modification is limited, it will fail. Any system's inherent ability to adapt to evolving times and needs aids in its survival and improvement.
